Why Machinery Guarding is a Legal Requirement for Australian Manufacturers

If you operate a manufacturing, warehousing, or industrial facility in Australia, machinery guarding is not optional. It is a legal obligation under the Work Health and Safety Act 2011 and associated regulations, and failing to meet that obligation puts your workers, your business, and your licence to operate at serious risk.

The Legal Framework

The WHS Act requires that persons conducting a business or undertaking (PCBUs) eliminate or minimise risks to health and safety so far as is reasonably practicable. When it comes to moving machinery, automated equipment, robots, and production lines, physical separation is one of the most effective engineering controls available.

The WHS Regulations go further, requiring specific safeguards for plant and machinery that could cause injury through contact, entanglement, or ejection. Guarding is not just best practice. It is a compliance requirement with real consequences for non-compliance.

Safe Work Australia’s guidelines on managing risks of plant in the workplace outline a clear hierarchy of controls. Engineering controls, including physical guarding and barriers, sit above administrative controls and personal protective equipment. Australian Standards for Machinery Guarding: AS 4024.1

Beyond the WHS Act and Regulations, compliance with the AS 4024.1 series of Australian Standards is considered best practice and is referenced by regulators and courts when assessing whether a duty holder took all reasonably practicable steps to manage machinery hazards.

The AS 4024.1 series covers the full scope of machinery safety, including guard design and construction, interlocking devices, prevention of unexpected start-up, and the safety-related parts of control systems. Key standards within the series include:

AS/NZS 4024.1601 – Guards: General Requirements

Sets out general requirements for guards, including that they must be robust, correctly positioned, and effective at preventing access to dangerous areas without creating additional hazards. Specifies fixed, movable, and interlocked guard types.

AS/NZS 4024.1602 – Interlocking Devices

Covers interlocking devices that prevent machinery from operating unless guards are correctly in place, and ensure machinery stops automatically if a guard is removed or bypassed.

AS/NZS 4024.1603 – Prevention of Unexpected Start-Up

Addresses the prevention of unexpected start-up during maintenance or guard removal, including requirements for lockout and tagout (LOTO) procedures. Power sources must be isolated, and machinery must remain in a safe state until it is ready to restart.

Compliance with these standards is not a one-time event at installation. Guarding systems must be regularly inspected and maintained to remain effective. If a guard is damaged, misaligned, or bypassed, the compliance obligation is not met, regardless of what was originally installed. This ongoing maintenance requirement is one of the strongest arguments for investing in a high-quality, durable guarding system from the outset.

What Regulators are Looking For

State and territory WHS regulators, including SafeWork NSW, WorkSafe Victoria, and Workplace Health and Safety Queensland, actively inspect industrial facilities for machinery guarding compliance. Inspectors assess whether:

•  Physical barriers provide adequate separation between personnel and hazardous equipment

•  Access points are controlled and include lockable entry systems

•  Guarding systems are structurally sound and appropriate for the risk level

•  Layouts allow safe supervision without exposing workers to machine hazards

•  Guards are being regularly inspected and maintained

Penalties for non-compliance are significant and indexed annually. Under the model WHS Act, a category 2 offence (the most prosecuted tier, requiring only that a breach exposed someone to a risk of death or serious injury) can attract fines of close to $2.4 million for a body corporate. Individual officers also carry personal liability. Beyond financial penalties, the reputational and human cost of a serious workplace incident is considerable.
